GOVCON INSIGHTS AND INFORMATION:
GovCon M&A and Recertification: What Small Business Contractors, Investors, and Private Equity Firms Need to Know – The Small Business Administration’s (SBA) size and recertification rules have always been central to government contracting. But recent regulatory changes, and where we now stand in mid-January 2026, mark a meaningful shift in the GovCon M&A landscape, particularly for private equity firms and other investors. The “grandfathering” era is over. Successful GovCon M&A transactions now require buyers and sellers to identify, price, and actively manage size-status risk early in the deal process. Those that treat recertification as a post-close compliance exercise risk inheriting unexpected eligibility, revenue, and valuation exposure.
OIG Semi-annual Report to Congress – During the reporting period, the OIG closed 17 investigations, opened 13 new ones, and processed 58 substantive hotline complaints, while monitoring management challenges and undertaking audits on scheduling accuracy, cost recovery, and IT modernization. The report highlights ongoing initiatives to secure a budget floor to ensure independent funding, expand nonmonetary performance metrics, enhance workforce integrity, and sustain collaboration through peer reviews, employee training, committees, and records‑access processes.
False Claims Act Settlements and Judgments Exceed $6.8B in Fiscal Year 2025 – Settlements and judgments under the False Claims Act exceeded $6.8 billion in the fiscal year ending Sept. 30, 2025, Deputy Attorney General Todd Blanche and Assistant Attorney General Brett A. Shumate, head of the Justice Department’s Civil Division, announced today. That amount is the highest in a single year in the history of the False Claims Act. This year, whistleblowers filed 1,297 qui tam lawsuits, the highest number in a single year, and the government opened 401 investigations, including matters announced as Administration policy objectives. Settlements and judgments since 1986, when Congress substantially strengthened the civil False Claims Act, now total more than $85 billion.
